Coming back later from vacation because travel is cheaper then: This can be expensive for parents of schoolchildren. School attendance is compulsory in Baden-Württemberg. The legal basis for this is the state‘s school attendance ordinance. It states, among other things: “Every pupil is obliged to attend classes (…) regularly and properly.“ In the case of minors, parents must ensure that this is complied with. A leave of absence from school is only possible “in particularly justified exceptional cases“, writes Florian Mader from the Ministry of Education at the request of tuenews INTERNATIONAL. Vacation trips that begin before or end after the vacations are not among these exceptions.
A compelling reason for not being able to attend school is, for example, illness. Parents must inform the school immediately of the reason and the expected duration of the illness. This is stated in § 2 of the school law. In special cases, children can be granted leave of absence from school (§ 4 of the School Act). Important personal reasons for absence from school can be, for example, weddings of siblings, a death in the family or a move. In the case of short absences and a student exchange or a language course abroad, the class teacher decides, in other cases the school management.
Truancy has consequences in any case. According to information from the Ministry of Education, the school usually seeks a discussion with the parents first. In most cases, this also resolves the conflict. If the discussion does not lead to understanding, there are further options under the Education Act. These can range up to a fine (§ 92 of the Education Act: administrative offenses).
